N.J. Mediation Center, LLC is committed to professional ethics and standards that protect each party and assist the parties in resolving their conflicts.  Most importantly, N.J. Mediation Center, LLC provides a safe and private environment to resolve any issues out of court.  More than likely, this will save you valuable time and money and hopefully will reduce the stress and anxiety associated with going to court.  Parties will be assisted in facing the issues, discussing the issues, formulating possible resolutions, presenting positions to the other side(s), doing a “reality check,” discussing other options available to the parties if they are not able to successfully mediate the issues.  Sometimes parties procrastinate in dealing with the issues for various reasons and/or are not able to focus on the issues and possible ways to handle a situation.  With mediation, a trained mediator is sensitive to each party’s position, able to assist the parties to focus on the issues, and help the parties work together (yes, it’s possible) to resolve the dispute. The parties themselves make the determination of whether or not they will resolve the matter.  The mediator is there to help the parties “see” the issue or situation more clearly so that they can make informed decisions.

Our Motto is “Talk It Out, Work It Out.”  Sometimes getting the parties together in person and dedicating a specific time to focus on the dispute may be the first time the parties have concentrated on working out a solution.  It may be the first time the parties have faced a certain situation.  It may be the first time the parties have accepted a certain condition.  It can help the parties get out of “denial mode” and start to see that they can find a way to handle the situation.  The mediator assists the parties to feel empowered, that they will be able to make informed decisions relating to the matter(s) at hand.

 

People often ask: "Does mediation really work?"

It may not work all the time, but it does work much of the time.  It works best when the parties have committed to the mediation process itself and have “enough” information to make informed decisions.  Research shows that when you compare mediated cases to litigated cases, the parties who mediated are more likely to be satisfied with the results than parties who litigated the case.  Since in most cases, parties who mediated were actively involved in the mediated result. Litigated matters, on the other hand, are determined by outside parties who are not as familiar with the situation at hand as the parties  themselves.  This leads to much uncertainty.  At least with mediation, the parties can “agree” to a certain result and not leave things to chance.  In general, mediated matters also take less time and cost less money.  Just as important, the parties are also less likely to go back to court over unresolved issues.
